Car Sold For 2 Years Pending Payment

Tried Consumer Tribunal. No luck. IF i remember well only for cases below 25k.

Do you guys think that Micheal Chong MCA can help?

I suppose he can help, especially if he brings up the matter in newspapers highlighting such tactics used by used car dealers may not be a good publicity for that industry. Can try but I think he has more pressing cases to handle like ah longs, runaway girls and boys, rempit, so whether he can find time for your case is another matter. But can always try, and good luck.

Dear BCat,

I am on the opposite side of your case - the buyer. I am not in Msia and asked my brother to buy the car for me to use whenever I am back for vacation. I found the car listed in one of the online sites. Everything went smoothly, test drive until pick-up in Oct08. The dealer promised the loan will be settled and ownership transferred within a month - no big deal because road-tax still valid and can drive the car. Until now, bank said ownership still not transferred and loan still under previous owner - but not blacklisted because the dealer still pay the monthly installment using my d/payment money. The r/tax expired in May and the dealer renew it using previous owner's name and insurance - after numerous visits and 1 week late.

The seller only receive his money in Apr09. One employee of the dealer said the dealer has very big problem with cash flow and will only transfer the ownership and settle previous loan when it reached my loan amt. ie. my 15k d/pmt is used to pay for mine and other cars' original loan. It looks like it will be another year before the ownership will be transferred. He also said there is nothing I can do because loan are being paid (bank no issue) and if I insist in taking action, I will just wasting a lot of time, effort and money. The best and only thing to do is continue using the car until everything is settled.

Say along, your case is rather confusing....now let me undersatnd you. The seller sold the car to the dealer, but instead of redeeming the ownership from the Bank, the dealer is now using the money you paid for the downpayment to continue the instalment. Firstly it would be cheaper to redeem ownership as the owner will get some discount for early full settlement. I cannot understand why he wants to continue dragging the instalments using your downpayment he should use the downpayment and pay a lump sum and get the car redeemed earlier. Sorry you are in this predicament but I am still confused with the dealers actions.

The dealer dont want to redemm the car bcos they need to settle the total car loan. Instead they are utilising the down payment to pay others outstanding amount. Along can you pm me the car dealer? I got a feeling that it is the same car dealer. What i afraid is that the car dealer go bankruptcy and leave everyone in problem the buyer and seller.

You paid the d/payment. In this situation you are at the losing ground cos if anything happen to the car dealer, worst come to worst the car will go back the seller cos everything is under the seller name.

The dealer's shop name is three wovels only in S.Jaya area, I think (I'm not sure because my brother is the one buying the car for me using his name). Their website is very impressive as if they are very big company (***auto.com). Yes, the dealer is doing this because they don't have enough cash to settle the original loan - as admitted by one of the employee.

I know I'll be in big trouble if the dealer goes bankrupt and if the local system can be of any help (Kementerian, Tribunal, etc.). Fortunately, my brother knew the previous owner because same kampong as his wife. Worst come to worst I'll lose my 15k deposit and maybe have to fork out extra cash as deposit for a new loan. I'm really hoping it will not come to that.

Aiseh, dont know if this is fortunate or not.....if the dealer defaults you want to use strong arm tactics to hold the car oso cannot because the seller is oredi known to you. I belive you got receipt for the RM15,000.00 right? Then go to tribunal and claim your money back for non performance and tell your seller friend that this is between you and the dealer and you got nothing against the seller.

What I meant is that I have one less party to worry about. I heard fr my brother that the seller threatens to sue the dealer, maybe that's what make the dealer give him the money for the sale of the car. I don't think the dealer settles the previous owner's loan because when they renew my roadtax in May, it is still using the previous owner's name and my brother did not receive any notice from the bank (his loan was approved back in Oct08).

bro, another thing to consider, your loan approved in 2008 probably withdrawn oredi because it would appear to the bank that you are not taking the loan.

For your case...if user car dealer relucted to performance ownership transfer could it be any problem of puspakom inspection that possible like engine no are not matching chassis no ? or so call kretea sambung ? ......... so..why not you do it yourself for ownership transfer inspection...see any problem if you wanted the peacefull mind on your car ownership, if that is true that the car are unvalid for transfer that take it to court then....
