Help!...changed Of Ownership

The story here:

1) A car salesman promised to settle full payment to the car that I owned previously. (As I bought a new car from him).

2) I didnt sign the sales order (or any documents) when I passed him the car in dec 2010.

3) Problem arised when bank sent notice in April chasing for car installment for Feb and March.

4) I was not sure what happen and quickly called the salesman. 2 installments paid to the bank and matter went quiet again.

5) Problems came again in May when bank sent another notice for April outstanding.

6) Feeling something not so right there. Called the salesman what happen and was given non-sense excuses. Asked him why agreed to settle full payment in Dec 2010 but nothing to be done. He told me the car dealer last minute cancelled and didnt take the car..fuyoooo!.. I asked him what to do now? He told me he has passed the car to another dealer and is now looking for buyer.

7) I asked him to arrange meeting with the dealer. I wanted to see myself the car personally and also to know the status whether it is still in Penang (btw i am from penang). Yes, he brought us to the place but the dealer and car not in there.

8) Again, the salesman promised to settle this matter for me. ..OK, April payment paid on 1-6-2011.

9) bank sent another letter again for May outstanding. The letter came in registered post and putting a phrase of reposes if not payment made.

10) Something is definately not right. Quickly made police report to cover myself, just in case anything happen to the car.

11) The salesman called me again and said the dealer will pay the installment for 3-mth till July, meaning to pay for May, June and July installment.

12) I admitted that I made the mistake of not signing any docs when I passed the car to the salesman.

I am thinking of getting the bank to pull back (reposses) the car and stored in their warehouse for auction. While waiting for the auction, I will pay the monthly installment.

Pls advice if this can work or any good advice for me.

Thank you and extremely urgent to settle this asap.

How did they pay for ur car?

Less outstanding amount to bank?

Wow! Didn't sign anything or any legal documents and handover the car to the car dealer?
You must had a lot of trust in that salesman huh.

I even make a police report that as at the day and time itself I sold and handed over my car, to so and so -
just to be on the safe side if anything happens after that! an accident, tarffic offence or worst if the car is stolen and used for robbery - I dont have to be responsible!

Sound you've good income, which money doesn't matter.

Really i don't know to solve your problem, BTW can you share with forumer here:

i) you sold that car to personal 'saleman' or dealer/shop. Don't you know the car selling procedure?

ii) are you trade-in your car ?

iii) do you get money from that saleman? ( when you car value is higher than loan balance) ??

iv) do you put down payment to your new car??

iv) do you know that you will be 'blacklisted' by financial institution if you fail to repayment?

v) what car brand is that?
