Need Help .....urgent

hi all,

first of all im sorry if i post it on the wrong section .

a friend of mine had sell his car to a used car on january and the dealer promise to settled the balance of the remaining with bank, but time passed untill this month march they still havent settled the loan with the bank !
they just pay 5mth installment but not settled yet .everytime my friend called up the dealer they r giving excuses or dont want to pick up the phone. is there any legal action she could act on them ? if they happen not to settled the loan she is going to end up paying the loan by herself cause is still under her name .
thank a lots ....need advised badly

Not so simple bro.....the Car is under HP, so the Owner is actually the Bank. If anybody can take back the car it must be the Bank. And the Bank will tow it away only if too much owing, and before that they will just harrass the Hirer (the buyer). The only way is to slow talk the car dealer and plead to him to settle, want to go into argument also not worthwhile especially you already got part of the sale money from him. This is a messy arrangement and just hope and pray that the car dealer settles it.

Thats why such things as other people will continue payment, buyer will settle loan etc etc are not recommended, so many unhealthy things could happen. But then sometimes financial circumstances cause us to go into such arrangements. The only thing is go into such arrangement with your eyes wide open to the negative possibilities....

Looks like a convenient approach ended inconvenient!

Depending on your luck in this difficult time was one people will try to avoid. Used car dealer is also having hard time to sell cars. So, it is very likely the dealer will play hanky-panky with your friend.

Agree here.......No other way la......just ask your friend to pray hard that the dealer manages to sell that car soon.

in this case , the used car dealer normaly will pay few months installment on behalf of the car owner and try to get buyer for this car, if still can not sell off then they will pay another few month installment again . this is they try to avoid bring out a huge amount of money to settle your loan. if they settle your loan at once and the car can not sell off in short period , they loosing alot of profit.

You are 101% right....thats how they do business and since now is bad times....lagi teruk la....Only hope is that car price dont go down too much that it is lower than the hutang, then they probably let the Bank tarik and the Bank will chase the Hirer la...........of course this is worst case scenario....
