Bought Car With Intensive Welding

hi all

need your advice, i bought a car last year from a mechanic but when i recenly took it to do a spray job, the spray job guy said the the car got lot of unusual welding and the floor panel also welded.. he told me if this car go for inspection for sure will fail... my problem is what should i do:

1) make a police report ?

2) go to consumer ?

3) he also told me can use but i can't never sell the car or if suddenly jpj ask to go for inspection then i die.

i bought this car together with a request to change the engine and the mechanic charge me a 2k for the inspection saying that if i don't pay, jpj will will make issue on my brakes or anything just to trouble me but now i know it is b'coz to pass the inspection.. also i was told its his car but after he pass everything to me the grant says its an indian guy's name.

also he refuse to issues any receipts on the work or the car.... i hope someone here can help me with this..

You have bought a 'kereta potong'. Obviously, the mechanic who sold u the car bribed someone in Puspakom to pass the test.

You must immediately make a report, else, both the seller and Puspakom will say the accident was after the sale and is your fault.

He mentioned he bought last year woh! So the mechanic will sure say not his fault already..... smile_shock.gif

Missed that part that he bought the car last year.

Yes, the mechanic will definitely say that the car was fine as it passed 'Puspakom' inspection and it would seem that our friend is screwed. But I think he can still make a "Police Report" and see what happens from thereon.

To TS, how well did you know the mechanic who sold you the car?

There is also a danger if TS going to make a police report now the car already in his possession since last year after "PAID" puspakom inspection pass.

1. Police might ask TS to send the car for another Puspakom Inspection.
2. Police might suspect this is a stolen vehicle.
3. New engine might not registered with JPJ
4. Workshop never issue any receipt therefore there's no proof to show that the workshop is the broker or involve in this dealing.
5. If found the car chassis and engine number have been temper with, TS might be arrested/summon of buying a stolen vehicle.
6. TS might not able to drive/own his car anymore.

The above is solely my concern and imagination.

The best TS can do is to use the car carefully and not involve any accident until kingdom comes provided TS can still renew the yearly road tax, BUT this is not adviceable. When nothing happens when you use this car, then everything is OK. If something happens, you can be in deeper sh@t than now.

The moral of the story is, never to buy a car whitout a Sales&Purchase Agreement (simple one will do), copies of identification of buyer/seller, vehicle transfer form (sign and certified true copy), photocopy of Bankdraft/cheque (never use cash) and of course Receipt either a separate one or the amount "payable and received by" clearly stated in the S&P, signed by both parties (seller & buyer) with one witness.

So, TS here is the rugi party and hope the car TS bought is not too expensive.

The grant got say floor panel repair but my new mechanic say even this for sure kena one... also another friend say can take to jabatan kimia to proof when the welding was done..and if proof it was b4 transfet of ownership then can sue the former owner and claim the test charges too...

b4 this he got say the car got welding coz to make the body more stiff... !!


i spend alot of money al;ready on this car more then market price... i can accept if the car is no issue but this like free money i give that bloody cheat..!

if i report then for sure the car black listed... my friend advice 2 things.. ask for compensation or sue...!

you guys any idea ???

The Jabatan Kiama (or Chemistry Department) is the Forensic Dept of the Govt, like CSI. Yes, they can do test to determine when the welding was done but the results are not 100% accurate, just an approximate. So, the longer you delay, the less accurate it becomes.

The real issue is whether they would do it for you, cos I am not sure whether they service member of the public. If this had become a Court Case, then the Court would ask for results from the Chemistry Dept to be tendered as a proof and they would be obligated to service you.

Not easy to sue. used car are sold "As it where it condition"

And the questions is, who are you suing? The owner or the fellow that sold the car to you?
